Welcome to Transit Chaser (“Transit Chaser”, the “App”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) explain the rules for using Transit Chaser, a free web application created by Rey Sandu Godakumbura to help photographers, astronomy enthusiasts, and the wider community plan and capture aircraft transits, contrails, plane-on-plane alignments, and other sky-related photographic opportunities.
By accessing or using Transit Chaser, you agree to these Terms. If you do not agree with these Terms, please do not use the App.
Transit Chaser is a photography-planning and hobby tool. It uses publicly accessible and/or third-party aircraft data, celestial calculations, browser location features, and user-selected settings to estimate when aircraft may visually align with the Sun, Moon, other aircraft, contrails, or selected areas of the sky.
Transit Chaser is intended for photography planning, hobby, educational, and community use only.
Transit Chaser is not an aviation, navigation, safety, emergency, drone-avoidance, aircraft-separation, air-traffic-control, or operational flight tool. You must not rely on Transit Chaser for any safety-critical purpose.
By using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy & Cookies Policy.
We may update these Terms from time to time. Continued use of the App after updates are posted means you accept the updated Terms.
You must be at least 13 years old to use Transit Chaser, or older if your local law requires a higher minimum age. If you are using the App on behalf of another person or organisation, you confirm that you have authority to do so.
Transit Chaser does not own, operate, or control the third-party flight-data networks, receivers, APIs, or services used by the App. Aircraft positions, callsigns, aircraft types, altitude, heading, speed, and other flight information may come from external providers such as Airplanes.live, ADSB-One, ADS-B Exchange, OpenSky, Sydney Airport schedule data, or other services that may be added, removed, changed, limited, or replaced over time.
Flight data may be delayed, incomplete, inaccurate, unavailable, rate-limited, blocked, or changed by the relevant provider at any time. Transit Chaser cannot guarantee that any aircraft shown in the App is correct, current, visible, safe, or actually aligned with a target.
You acknowledge that all third-party data remains subject to the relevant provider’s own terms, policies, limits, and availability. You must not use Transit Chaser to bypass, abuse, scrape, overload, or violate any third-party data provider’s rules.
If a third-party provider changes its service, blocks access, imposes rate limits, changes its data format, or stops offering data, Transit Chaser may partially or completely stop working without notice.
Transit Chaser predictions are estimates only. Aircraft movement can change quickly due to turns, climbs, descents, speed changes, wind, data delay, receiver coverage, incomplete ADS-B data, or other factors outside our control.
Celestial calculations, aircraft projections, detection margins, and visual alignment estimates may contain errors. A predicted transit may not happen, and a real transit may be missed.
You are responsible for using your own judgement when planning or attempting photographs. Always follow local laws, property rules, safety rules, airport restrictions, drone rules, and common sense.
When using Transit Chaser, you agree that you will not:
Transit Chaser is currently provided as a free community tool for photographers and sky watchers. Because the App relies on third-party data and hosting services, we may need to limit features, slow refresh rates, pause sessions, change providers, disable modes, show warnings, or temporarily restrict access to keep the App running responsibly.
We do not guarantee that the App will always remain free, available, uninterrupted, or unchanged.
Transit Chaser may offer optional email alerts for selected detection modes. Email alerts are provided on a best-effort basis only.
Email alerts may be delayed, blocked, rate-limited, fail to send, go to spam or junk folders, or contain inaccurate prediction information. You should not rely on email alerts as the only way to capture an event.
Your email address may be stored locally in your browser so the App can remember it for your session or future visits. When an alert or test email is sent, your email address is transmitted to our email delivery provider for the purpose of sending that message. We do not sell your email address or use it for marketing unless you separately consent.
Transit Chaser may allow users to upload or share photographs, captions, names, social links, or other community content.
You keep ownership of any photos or content you upload. By uploading or submitting content to Transit Chaser, you grant Transit Chaser a non-exclusive, worldwide, royalty-free permission to display, feature, resize, crop, store, reproduce, and share that content within the App, gallery, community sections, social posts, promotional material, or related Transit Chaser pages for the purpose of showcasing the community and the App.
You confirm that you own the content you upload or have permission from the rightful owner to upload and share it. You are responsible for ensuring your uploaded content does not infringe copyright, privacy, publicity, trademark, or other rights.
Transit Chaser does not claim ownership of user-submitted photos. We may remove uploaded content at any time for any reason, including suspected copyright issues, inappropriate content, technical issues, or community concerns.
If you believe content on Transit Chaser infringes your rights, please contact us and we will review removal requests.
Unless otherwise stated, the Transit Chaser website, code, design, branding, layout, text, scripts, tools, and original materials are owned by Rey Sandu Godakumbura or used with permission.
Third-party software, libraries, APIs, data, logos, names, and services remain the property of their respective owners. User-submitted images remain owned by their original creators.
You may not copy, reproduce, redistribute, sell, rebrand, reverse engineer, or commercially exploit Transit Chaser or its code without written permission, except where allowed by applicable law or third-party open-source licences.
Transit Chaser may use third-party software, APIs, libraries, hosting, email, analytics, advertising, mapping, and data services. These may include, but are not limited to:
We are not responsible for third-party services, their content, availability, accuracy, privacy practices, policy changes, pricing, or rate limits.
Transit Chaser may display advertisements or use analytics tools to understand traffic, support hosting costs, and improve the App. Third-party advertising or analytics providers may use cookies, identifiers, or similar technologies according to their own policies.
The App may contain links to external websites, data providers, social media profiles, galleries, donation pages, or other third-party services. We are not responsible for the content, accuracy, privacy policies, or practices of external websites.
Our Privacy & Cookies Policy explains how Transit Chaser handles location data, browser storage, email alerts, uploads, cookies, analytics, advertising, and third-party services.
By using Transit Chaser, you also agree to the Privacy & Cookies Policy.
Parts of Transit Chaser, including code, wording, documentation, or feature ideas, may have been developed with assistance from AI tools, including OpenAI tools. AI-assisted code and text can contain mistakes, bugs, omissions, or inaccuracies.
Any errors, omissions, bugs, security issues, or inaccuracies in Transit Chaser remain the responsibility of the author. If you notice a problem, please report it so it can be reviewed.
Transit Chaser is provided “as is” and “as available” without warranties of any kind, whether express or implied.
We do not guarantee that the App will be accurate, uninterrupted, secure, error-free, compatible with your device, available in your region, or suitable for any particular purpose.
To the maximum extent permitted by law, Rey Sandu Godakumbura and Transit Chaser will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or other damages arising from your use of, or inability to use, the App.
This includes, but is not limited to, missed photographic opportunities, incorrect predictions, inaccurate aircraft data, provider outages, email failures, loss of content, loss of data, device issues, travel costs, personal injury, property damage, legal issues, or reliance on App information.
You agree to defend, indemnify, and hold harmless Rey Sandu Godakumbura and Transit Chaser from any claims, damages, losses, liabilities, costs, or expenses arising from your misuse of the App, your uploaded content, your violation of these Terms, your violation of third-party rights, or your violation of any law.
If you believe content on Transit Chaser infringes your copyright, privacy, publicity, trademark, or other rights, please contact us with enough information to identify the content and your claim.
We may remove or disable content at our discretion while reviewing the request.
We may change, pause, restrict, remove, or discontinue any part of Transit Chaser at any time, with or without notice.
We may block or restrict access if we believe the App is being abused, scraped, overloaded, used unlawfully, or used in a way that risks harm to the App, its users, or third-party providers.
These Terms are governed by the laws of New South Wales, Australia, unless local consumer law requires otherwise. Where permitted by law, disputes will be handled by courts located in New South Wales, Australia.
